Return & Refund Policy

We believe in fairness and transparency. This policy explains exactly when and how refunds apply to our AI services β€” no jargon, no ambiguity.

We understand that circumstances can change, and we have designed this policy to be as fair and transparent as possible. Please read it fully before engaging our services. By making any payment to us, you agree to the terms of this policy.

Overview

This Return and Refund Policy governs all financial transactions between AITechGen Technologies ("we", "our", "us") and our clients ("you", "client") for AI development services, consulting engagements, training workshops, and related deliverables.

Because we provide custom AI and technology services β€” not physical products β€” the concept of a "return" does not apply in the traditional sense. Instead, this policy focuses on project cancellations, milestone disputes, and refund eligibility based on the stage of work at the time of cancellation.

Key Principle: You pay for completed work. Any portion of a project that has not yet been started is eligible for a refund. Work that has been completed and delivered is non-refundable, as the intellectual effort and time cannot be reversed.

Nature of Our Services

AITechGen Technologies provides the following categories of services, each of which has specific refund considerations:

  • Fixed-Price Projects: AI development with a defined scope, delivered across agreed milestones (e.g., ML model, NLP chatbot, Computer Vision solution).
  • Monthly Retainer Plans: Ongoing AI development, maintenance, and support billed monthly.
  • Training & Workshops: Instructor-led AI training sessions for client teams.
  • Consulting & Strategy Sessions: One-time or recurring AI advisory sessions.
  • Add-On Services: Dashboard development, data audits, multi-language NLP, extended support.

All services are delivered by our expert team, and time invested in your project β€” even partially β€” represents real, irreversible effort. This is why our policy differentiates between completed and not-yet-started work.

Cancellation Policy

Either party may cancel a project or retainer engagement as follows:

A
Cancellation Before Work Begins
If you cancel before any work has commenced (typically within 48 hours of advance payment), you are eligible for a full refund of the advance, minus a 5% processing fee to cover administrative and payment gateway costs.

Cancellation During Active Development
If work is already underway, refunds are calculated based on the percentage of the project completed at the time of cancellation. Completed milestones are non-refundable. Unstarted milestones are fully refundable.

Cancellation by AITechGen Technologies
If we cancel the project due to reasons entirely within our control (e.g., inability to deliver as agreed), you will receive a full refund for all work not yet completed, including a pro-rata refund for any partially completed milestone.

Retainer Cancellation
Monthly retainer plans can be cancelled with 30 days' written notice. The current billing month is non-refundable once commenced. The next month's fee will not be charged if notice is received before the next billing cycle.

Refund Eligibility

A refund may be issued under the following qualifying conditions:

  • The project is cancelled before the relevant milestone work has commenced
  • AITechGen Technologies fails to deliver a milestone within the agreed timeline by more than 14 business days without prior written notice or approval from the client
  • The final delivered solution materially fails to meet the agreed specifications documented in the signed Statement of Work (SOW)
  • Duplicate payment was made by the client due to a technical error
  • A retainer plan is cancelled with proper 30-day notice before the next billing cycle begins

All refund requests must be submitted in writing to careers@aitechgentechnologies.com within 7 days of the event giving rise to the refund claim. Requests submitted after this window will not be eligible.

Non-Refundable Items

The following are explicitly non-refundable under all circumstances:

  • Completed & Delivered Milestones: Any work that has been completed and delivered to the client, regardless of whether the client has reviewed or used it.
  • Consultation & Strategy Sessions: One-time advisory or consulting calls that have taken place are fully non-refundable.
  • Training Workshops (Attended): Training sessions that have been conducted are non-refundable, even if the client was not satisfied with the outcome.
  • Third-Party Costs: Any costs incurred on your behalf for cloud services, API usage, data acquisition, or other third-party tools are non-refundable.
  • Advance Payment Processing Fee: The 5% administrative processing fee is non-refundable in all cases.
  • Scope Change Requests: Work done for approved scope changes or additions, even if later cancelled, is non-refundable.
  • Delays Caused by Client: If project delays are caused by the client's failure to provide data, approvals, or feedback on time, resulting costs are non-refundable.

Important: Dissatisfaction with AI model performance that falls within the accuracy ranges documented in the project agreement does not constitute grounds for a refund. AI model performance is inherently dependent on data quality, which we do not fully control.

Refund Process & Timeline

If you believe you are eligible for a refund, follow these steps:

Submit a Written Request
Email us at careers@aitechgentechnologies.com with subject line "Refund Request β€” [Your Project Name]". Include your project ID, payment reference, reason for cancellation, and the amount you believe is refundable.

Acknowledgement (Within 2 Business Days)
Our team will acknowledge your request and assign a case number. We may ask for additional documentation or clarification at this stage.

Review & Assessment (3–7 Business Days)
We review the project status, completed milestones, and your request against this policy. Our project manager will calculate the eligible refund amount based on work completed at the time of cancellation.

Decision Communicated
We communicate our decision in writing, including the approved refund amount, calculation breakdown, and reason. If your request is partially or fully declined, we explain why clearly.

Refund Processed (5–10 Business Days)
Approved refunds are processed to the original payment method within 5–10 business days of the decision. Bank transfer times may vary. UPI/bank refunds typically arrive within 3–5 business days after processing.

GST paid on services is generally not refundable as it is remitted to the government. If you are a GST-registered business, you may be able to reverse the input tax credit on your end. Please consult your CA for guidance.

Monthly Retainer Plans

For clients on monthly AI Retainer plans, the following specific rules apply:

  • Minimum Commitment: All retainer plans require a minimum engagement of 3 months. The first 3 months are non-cancellable unless AITechGen Technologies fails to deliver as agreed.
  • Cancellation After Minimum Period: After the minimum term, you may cancel by giving 30 days' written notice before your next billing date.
  • Mid-Month Cancellation: If you cancel after a billing cycle has begun, the full month's fee is due and non-refundable. You will receive full service for the remainder of that month.
  • Unused Hours: Any unused hours or deliverables within a retainer month do not carry over to the next month and are not refundable.
  • Upgrade / Downgrade: You may upgrade your plan at any time. Downgrading is permitted from the next billing cycle with 14 days' notice.

Add-On Services

Add-on services purchased separately (dashboards, audits, training sessions, extended support) follow these rules:

  • Training Workshops: Cancellation with more than 5 business days' notice β€” 50% refund. Cancellation with less than 5 days' notice or post-session β€” no refund.
  • Dashboard Development: Same as project milestones β€” refundable only for work not yet started.
  • Data Security Audit: Non-refundable once the audit process has commenced (access to systems granted).
  • Extended Support Plans: Monthly extended support can be cancelled anytime with 14 days' notice. Current month is non-refundable.
  • Mobile App Integration: Treated as a project milestone β€” refundable only for work not yet started.

Dispute Resolution

We aim to resolve all refund disputes amicably and fairly. If you disagree with our refund decision:

  • Step 1 β€” Escalation: Request an escalation review by emailing the same thread with "ESCALATION" in the subject. A senior manager will review your case independently within 5 business days.
  • Step 2 β€” Mediation: If still unresolved, both parties agree to attempt resolution through a neutral mediator before pursuing legal action.
  • Step 3 β€” Legal Proceedings: Any unresolved disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India, under the laws of India.

We have resolved 100% of refund disputes amicably to date. Our goal is always a fair outcome for both parties. We encourage open communication at every step β€” please don't hesitate to reach out.
